SC refuses information on its recommendation to elevate Justice Dinakaran
The Supreme Court has refused to part with the information of the proceedings which led to the court’s Collegium recommending the elevation of Karnataka High Court Chief Justice P D Dinakaran to the apex court, under the provisions of the Right to Information Act.
The Supreme Court Collegium is headed by Chief Justice of India K G Balakrishnan and comprises four senior most judges.
The elevation of Justice Dinakaran was put on hold following the allegations of land grabbing and corruption against him. He has also withdrawn himself from judicial work and is not holding court at present.
An inquiry by a three judge’s bench committee headed by Supreme Court judge B Sudarshan Reddy is underway.
The name of Justice Dinakaran was recommended along with four others who have already been elevated to the apex court.
RTI applicant Subhash Chandra Aggarwal had demanded to know whether other judges like Justices Markndey Katju, A K Ganguli and S Sirpurkar who were judges of the Madras High Court were consulted by the CJI as per the nine-judge bench judgement in the AOR associations case.
The apex court, while refusing to divulge the information sought under the RTI Act said the apex court had stayed the operation of the order of the Chief Information Commissioner in this regard.
